Retirement insights from a Colorado PERA perspective

For its first meeting of 2022, the PERA Board of Trustees returned to an all-remote format due to the ongoing COVID-19 pandemic. Trustees met virtually on January 21.



Board members heard a number of updates from PERA staff, highlighting work that was done in 2021 and projects that will take place in 2022:



<ul><li>PERA’s Benefit Services Division provided an update on transitioning PERAPlus 401(k)/457 and Defined Contribution plans to <a rel="noreferrer noopener" href="https://coperaplus.org" target="_blank">Empower Retirement</a>, which took place in December.</li><li>Members of PERA’s Investment Division held a “fireside chat” with the Board, discussing economic conditions in 2021 and the performance of various asset classes. Staff also <a rel="noreferrer noopener" href="https://content.copera.org/board-discusses-pera-related-bills-at-january-meeting/" target="_blank">provided an update on the market and PERA’s portfolio</a>.</li><li>PERA’s Communications Division provided an update on <a href="https://www.copera.org/board-discusses-pera-related-bills-at-january-meeting" target="_blank" rel="noreferrer noopener" class="broken_link">member satisfaction survey data</a> and the newly updated <a rel="noreferrer noopener" href="https://www.copera.org" target="_blank">copera.org</a>, which <a rel="noreferrer noopener" href="https://peraontheissues.com/pera-launches-redesigned-website-with-better-navigation-other-improvements/" target="_blank">launched in January</a> with better navigation and other improvements.</li></ul>



<h4 class="wp-block-heading" id="pera-related-legislation">PERA-related legislation</h4>



The Board also heard from PERA’s public and government affairs manager and discussed <a href="https://peraontheissues.com/2022-proposed-legislation-status/" target="_blank" rel="noreferrer noopener">four PERA-related bills that have so far been introduced</a> at the Colorado General Assembly:



<ul><li><a href="https://leg.colorado.gov/bills/hb22-1029" target="_blank" rel="noreferrer noopener">HB22-1029</a> calls for the state to make up its missed $225 million payment to PERA from 2020, plus estimated investment gains had that money been invested. The Board voiced its support for the bill.</li><li><a href="https://leg.colorado.gov/bills/hb22-1087" target="_blank" rel="noreferrer noopener">HB22-1087</a> would exclude special district board members from being eligible for membership in PERA for their service as directors. The Board did not take a stance on the bill, as it is not expected to have a significant financial impact on PERA.</li><li><a href="https://leg.colorado.gov/bills/hb22-1057" target="_blank" rel="noreferrer noopener">HB22-1057</a> and <a href="https://leg.colorado.gov/bills/hb22-1101" target="_blank" rel="noreferrer noopener">HB22-1101</a> would change some of the rules for working after retirement for PERA retirees working for school districts. While the PERA Board is sensitive to the needs of school districts facing staffing shortages, expanding working after retirement provisions to allow retirees to work without a reduction in their benefits will increase PERA’s liabilities. As fiduciaries, pursuant to its funding policy, the PERA Board opposes legislation that increases liabilities or reduces contributions until PERA is fully funded.</li></ul>



PERA On The Issues will continue to track the status of each PERA-related bill and will provide updates as available.



The PERA Board’s next meeting is scheduled for March 18.

Board Discusses PERA-Related Bills at January Meeting

In January, <a href="https://content.copera.org/legislative-qa-with-peras-public-and-government-affairs-manager/" target="_blank" rel="noreferrer noopener">we spoke with</a> Michael Steppat, PERA’s Public and Government Affairs Manager. As the Colorado legislative session winds to a close, we checked back in to get his thoughts on a number of different topics.



<h4 class="wp-block-heading">The legislative session usually ends in early May. However, this year’s legislative session started with a multi-week recess due to COVID-19. So where does that put us now?</h4>



The state legislature can meet for no more than 120 days. The delay essentially just extended the deadline for the general assembly to adjourn sine die—the formal term used when the legislative session ends for the year. The number of days they were on recess can just be tacked on to the end of the original end date. That means the legislature must adjourn on or before June 12.



<h4 class="wp-block-heading"><a href="https://peraontheissues.com/2021-proposed-legislation-status/" target="_blank" rel="noreferrer noopener">Two bills related to PERA</a> have passed. What can you tell us about them? What effect will they have for PERA members?</h4>



PERA retirees who go back to work at a PERA employer in retirement must follow certain rules set by law. House Bill 21-1136 modified the provisions created for judges who work in retirement. These changes were made in order to address the massive caseload backlog caused by the pandemic and only affect retired judges.



Another bill, Senate Bill 21-228, set aside funds in the current fiscal year to be used by the state for future employer contributions or disbursements to PERA. This bill does not change anything about how PERA works. This bill was created primarily to give lawmakers additional flexibility to operate within Colorado’s state budget rules.



<h4 class="wp-block-heading">What is the status of last year’s direct distribution, which was part of across-the-board cuts the legislature made to the budget? Will this year’s $225 million direct distribution be made to PERA?</h4>



PERA did not receive the $225 million direct distribution in 2020, however the full direct distribution to PERA was restored going forward, including this year’s payment.



<h4 class="wp-block-heading">Do you expect any other PERA-related bills to come up this session?</h4>



I don’t expect any more bills that are directly related to PERA.



<h4 class="wp-block-heading">Many pieces of major federal legislation have been passed in the past few months. Do any of these impact state finances in a way that will affect PERA?</h4>



Anything that impacts state finances can potentially have an indirect effect on PERA, as we saw last year with the budget cuts that had to be made. However, there isn’t anything we’ve seen in any of the pandemic-relief-related federal legislation that would affect PERA directly. It’s also important to keep in mind that federal law prohibits state lawmakers from using the funds sent to them in recent COVID-related legislation for pension-related purposes.



<h4 class="wp-block-heading">As is the case most years, there is a bill to repeal the Government Pension Offset and Windfall Elimination Provision in Social Security. What is the state of that bill?</h4>



House Resolution 82, <a href="https://peraontheissues.com/wep-gpo-bill-introduced-in-d-c/" target="_blank" rel="noreferrer noopener">which would repeal the GPO and WEP</a>, was introduced earlier this year. While it has gained cosponsors since it was introduced in January, we haven’t seen it move through legislative process.



A second bill has also been introduced recently. While this second bill would not repeal these Social Security-related measures, it would make some changes to the WEP. Bill Title: PERA Public Employees Retirement Association Payment Cash Fund



Concerning the creation of the PERA payment cash fund to be used for future payments to the public employees&#8217; retirement association, and, in connection therewith, making an appropriation.



Bill Summary: The bill creates the PERA payment cash fund (fund) and appropriates $380 million from the general fund to the fund for the 2020-21 state fiscal year. The state treasurer is required to use the money in the fund for the $225 million direct distribution payment to PERA on July 1, 2022, subsequent direct distributions, and any of the state&#8217;s employer contributions or disbursements.

Bill Title: PERA Public Employees&#8217; Retirement Association Divestment From Fossil Fuel Companies



Concerning divestment action by the public employees&#8217; retirement association against companies financially involved with fossil fuel companies.



Bill Summary: The bill would require the PERA Board to create an exclusion list of all direct investments PERA has in fossil fuel companies.



Within 6 months after completing the exclusion list, the Board would be required to determine whether divestment from the companies on the exclusion list complies with the Board&#8217;s fiduciary obligations. If the Board determines that divestment from any company on the exclusion list does not comply with its fiduciary obligations, the Board will remove the company from the exclusion list.



If the Board determined that divestment from any company on the exclusion list does comply with its fiduciary duty, the Board would be required to divest from those companies on the exclusion list. And the Board would be required to cease new direct investments in any company that is a fossil fuel company.



Beginning one year after the effective date of the bill, the Board would be required to ensure that no money or assets of the fund are invested in an indirect investment vehicle unless the Board is satisfied that such indirect investment vehicle is unlikely to have in excess of 2% of its assets directly or indirectly invested in fossil fuel companies.



The Board would be required to issue periodic reports to the members of the pension review commission of the General Assembly outlining all actions taken to comply with the requirements of the bill.

Global issues are difficult to prioritize and proper recourse falls beyond the duty of the retirement system. PERA opposes divestment efforts unless such opposition is inconsistent with its fiduciary duty and recommends the legislature thoughtfully consider such proposals with caution and fiduciary care.

Bill Title: Judicial Division Retirees Temporary Judicial Duties Compensation



Concerning modifications to the policies governing judicial division retirees returning to temporary judicial duties.



Bill Summary: Retired judges may currently perform judicial duties for 60 or 90 days with written permission from the chief justice of the Colorado Supreme court. This bill would allow retired judges to do the same for 20, 30, 60, or 90 days per year. In addition, under current law a retired judge must enter into the agreement prior to retirement or within thirty days prior to the retirement anniversary in the next five years of retirement. This bill would remove that limitation.

Bill Title: Conversion Of Pinnacol Assurance



Concerning the conversion of Pinnacol Assurance from a political subdivision of the state into a stock insurance company owned by a mutual insurance holding company.



Bill Summary: This bill would convert Pinnacol Assurance, which provides workers’ compensation insurance, into a private company. As part of this conversion, Pinnacol would disaffiliate from PERA and make a payment to PERA to cover its portion of PERA’s liabilities. Current Pinnacol employees would become inactive PERA members after the disaffiliation date but would be eligible for future benefits. Current PERA retirees who were employed by Pinnacol are not affected by this bill.

According to a September 2020 study, about three-quarters of retirees say their retirement lifestyle doesn&#8217;t match their pre-retirement expectations. What’s the reason? There are multiple. Plans of seeing the world, for example, might actually become a lower priority: Staying healthy is the number-one priority for retirees, followed by “quality time spent with family and friends.” Traveling is a “distant third.” Another reason? Fear of outliving assets.

A question that’s often asked is: “how will COVID-19 affect life expectancy?” The loss of life has been staggering over the past year. This analysis shows that while life expectancy is unlikely to be affected much in the long run, it also not the best measure to use when trying to capture the magnitude of COVID-19’s impact.

For the third time in three years, Rep. Dylan Roberts (D-Avon) is running a bill in the Colorado legislature that would create a public health care option and be available to all Coloradans. Despite the bill failing in previous years, Roberts said such a plan would provide lower-cost health care, particularly in areas without many other options. A new feature in this year’s version: insurers, care providers, and others would be given certain goals to reduce patient costs. A state option would be offered to Coloradans in 2025 only if those goals are not met.

One client captured the sentiment, saying: “I don’t know if I can actually start to withdraw the money and feel good about it. Financial experts often advise individuals to hold steady during times of market volatility rather than trying to “time the market,” which means guessing whether investments will go up or down in the short term. Data from Morningstar shows that during 2020’s market volatility, the vast majority of investors heeded this advice. About 19 out of 20 people in this dataset didn&#8217;t changed their allocation in the first quarter last year. People who use target-date funds were the least likely to change their holdings.

Colorado’s legislature is back in session. Again. After a month-long hiatus, lawmakers are working through a growing pile of bills. Addressing the pandemic and economic recovery are the top priorities. But other issues, including transportation and education funding and police reform, made this list of pressing issues. Altogether, tax revenue collected by all 50 states dipped 1.9% last year between April and December. But not every state was created equal. In fact, 22 states actually increased revenues during that time. And Colorado was one of five states who finished the year up at least 5%. Why? The particular makeup of tax revenue streams varies from state to state. While Colorado has a big tourism industry, the state as a whole is less reliant on tourism than, say, Nevada. Tourism is an industry hit particularly hard in the past year. The number of higher-earning households, which have not experienced the same financial burdens as others for a variety of reasons, also has had an effect.

Having an appointment to get vaccinated against COVID-19 is great…if you have a way to get there. Last year’s legislative session took a strange turn in March. In 2021, it will be unusual off the bat.



On January 13, the legislature will formally start, or “gavel in,” to meet a legal requirement. But it is expected to “gavel out” soon after. This doesn’t mean that session will end. Instead, it will be put on pause until at least mid-February – similar to the mid-session pause we saw last year.



As Colorado’s 100 legislators veer away from the deep ruts of tradition in response to the global pandemic, what will guide them? How will important work get done? What issues will they tackle, and which issues might be pushed aside? These are just some of the many questions Coloradans have as this unusual session begins.



<h5 class="wp-block-heading">When will work get done?</h5>



“The key word still is uncertainty,” said Michael Steppat, PERA’s Public and Government Affairs Manager. “What happens in the building is totally dictated by the external environment.”



Lawmakers don’t have a set date to come back because there’s no way to tell what the public health situation will look like next week, let alone next month.



Lawmakers are still constitutionally bound to meet for no more than 120 days, but last year’s state supreme court ruling means that, during an emergency, the days between gaveling out and gaveling back in don’t count against that limit. This gives increased flexibility to leaders.



<h5 class="wp-block-heading">What work will get done?</h5>



Just because the full legislature won’t meet, that does not mean that legislative work will grind to a halt. Some committees, including the Joint Budget Committee, will continue to meet and move forward with their work.



It might sound obvious, but Steppat said “Lawmakers’ top three priorities are the pandemic, the pandemic, and the pandemic. Everything ties to it.”



As far as PERA-related legislation, Steppat said he’s keeping an eye on the status of PERA’s <a href="https://peraontheissues.com/polis-budget-plan-includes-pera-direct-distribution/">direct distribution</a>, covered more below. Like the past few years, there’s also a possibility that lawmakers consider legislation related to PERA&#8217;s investment program.



<h5 class="wp-block-heading">Writing the budget</h5>



One important waypoint in the legislative calendar is passing a budget. Colorado’s constitution requires lawmakers to pass a budget before they stop work for the year. The Joint Budget Committee (JBC) writes the budget before it’s brought to the full House and Senate.



“Writing a budget isn’t easy, even in a surplus year” Steppat said. “The JBC just went through an unprecedented budget writing process, and that’s not going to get any easier.”



The JBC starts the budget writing process in November and typically completes its proposed budget by late March. The House and Senate usually debate, amend, and pass the budget in the first few weeks of April. From there, it goes to the governor for a signature.



The state’s fiscal year ends on June 30. Steppat said lawmakers likely view that date as a de facto deadline for passing a budget, even if they plan to continue other work into the summer or even fall.



<h5 class="wp-block-heading">The state of the economy</h5>



The sudden shutdown of the nation’s economy led to last year’s budget emergency. As state revenue streams dried up in historic fashion, lawmakers sprinted to cut billions from previously planned spending. Cuts included the $225 million direct distribution to PERA, which PERA On The Issues has <a href="https://content.copera.org/polis-budget-plan-includes-pera-direct-distribution/" target="_blank" rel="noreferrer noopener">covered previously</a>.



Parts of the economy have recovered, but some sectors still face dire circumstances. Overall, uncertainty still looms over everything. To this end, keeping an eye on periodic budget forecasts produced by <a href="https://leg.colorado.gov/agencies/legislative-council-staff/economy-budget" target="_blank" rel="noreferrer noopener">Legislative Council</a> and the <a href="https://www.colorado.gov/governor/Office-State-Planning-Budgeting" target="_blank" rel="noreferrer noopener">Office of State Planning and Budgeting</a> is a good way to stay abreast of any changes.



Governor Polis indicated support for resuming the direct distribution in his budget proposal. Steppat said he is optimistic the direct distribution will be included in the budget that lawmakers send to the governor’s desk.
