Working After Retirement Rule Updates

Pursuant to legislation passed in 2024 (House Bill 24-1044), rule amendments change the deadline from March 31 to September 1, for employers to designate retirees working after retirement over the 110-day limit, and to reflect that the previous 10-person limitation for 140-day designations is expanded for more designees in larger districts.

The rule was also amended to clarify that retirees working beyond 110 days can only be designated once per position at each employer per year.  The 2024 legislation also added a six-year limit to certain working after retirement designations, so the amendment clarifies that the six-year limitation will be administered on a calendar year basis beginning January 1, 2025. After six consecutive years, the retiree must take one full calendar year break before being redesignated.
